It takes a great deal of experience to determine whether the poor surgical outcome was a known complication of the procedure or whether the surgical complication could have been avoided.

Our Investigation Process

We first look at whether the surgery was really needed considering the risks that accompany every surgery, which include, but are not limited to, infection, excessive blood loss and death. Next, we look at the procedure to see if it was done correctly. Lastly, we look at the post-operative care to see if the surgical error was discovered and treated timely. Many times, the surgical error was a known complication of the procedure, but it is the surgeon’s lack of follow-up care in diagnosing the problem that leads to a catastrophic outcome.

Likewise, the development of a post-operative infection is a known complication of every surgery, so the question is whether appropriate and timely precautions were in place to prevent the infection, and whether the infection was diagnosed and treated effectively and timely after surgery.
